Attorney: High Court Litigation


We are looking for an Attorney: High Court Litigation who has 5-7 years’ legal experience post-graduation/ admission of which 2 years must have been on area of expertise (personal injury litigation). The successful candidate will be responsible for all High Court matters within the Fund and to offer litigation services accordingly.


Minimum Requirements:

  • Admission as an Attorney (the candidate must have served pupillage and passed the admission examinations) of the High Court of South Africa.
  • Right of appearance in the High Court.
  • Relevant 5-7 years’ legal experience post-graduation or admission of which 2 years must have been on area of expertise (personal injury litigation).
  • Dispute resolution, mediation and negotiation skills.
  • Knowledge of Law of Delict including Personal Injury and Third party compensation law.
  • Knowledge of Civil proceedings in the Magistrate, Regional and High Courts
  • of South Africa.
  • Knowledge of relevant case law and Legislation.
  • Ability to draft pleadings, discovery of documentation on all court processes.
  • Experience in civil litigation.

Key Responsibilities:

  • Approve requests to appoint and instruct assessors and expert witnesses.
  • Attend to Court appearances in all allocated third party litigation matters.
  • Ensure file administration from opening to the conclusion of a legal case including adherence to trial dates.
  • Handle appearances at courts, tribunals, mediation hearings and enquiries.
  • Coordinate administrative legal actions to ensure compliance.
  • Approve instructions to appoint and instruct expert witnesses.
  • Block consultation, early assessment of files, early instructions to experts and assessors.
  • Ensure effective and efficient recording of all cases.
  • Compile weekly and monthly and annual reports.
  • Maintain trial register.
  • Conduct research that will provide information in preparation of all matters for trial.
  • Consult with client departments/ representatives, and witnesses for instructions and documentation for cases to be presented in Court.
  • All required steps regarding the mediation process, as governed by the amendment to the rules of court, to be taken.
  • Upon conclusion of mediation, parties shall inform Registrar and all other parties by notice that Mediation is completed.
  • Draft pleadings to provide clear motivation / justification on a particular position pertaining to the case
